The ultimate exit strategy: A when-I-die checklist
The first time I checked the organ donor check box on my driver's license, it was with the creepy suspicion that someone far luckier than me needed my liver.
I checked the box and, to my surprise, was not immediately run over by a bread truck. I've renewed my license many times since and lived to see the E-check line again.
Take it from me: Planning for death will not cause you to die.
It may, however, save those you leave behind from having to make decisions when they're really not at their best.
Planning for death may not be as fun as planning a trip to Italy, but if it's any consolation, Linda Betzer, president of a funeral consumer group, the Cleveland Memorial Society, offers this:
"You only have to do it once. It's not like taxes, which you have to do every year."
Think of this as the ultimate honey-do list:
• Don't leave your affairs in chaos. Parents of minor children should have wills that clearly designate a legal guardian. And older people shouldn't delay estate planning until they're too ill to make important decisions.
A clear, legally sound will is essential. Probate Judge Laura Gallagher says do-it-yourself wills can be unclear or impossible to carry out. For example, a person's jointly held assets might transfer outside of probate, leaving no money in the estate to fund bequests in the will. Or the courts may be left to sort out who gets the money if the deceased leaves money to a generic cause, rather than a specific organization.
The judge's advice: Know what you have, know what you want to do with it and sit down with an attorney to make sure your wishes are carried out.
• Play to your heirs' strengths. "Know who you trust," Gallagher cautions. It's one thing to split your possessions equally among your kids, but it's another to give the black sheep joint access to your bank accounts or appoint the child who argues about everything co-executor with his siblings. Choose an executor you trust to honor your wishes, preferably one who has the temperament for document-wrangling.
